General terms and conditions
1. General Provisions
1.1 These general terms and conditions apply to all offers, contracts, and deliveries related to the rental of Christmas trees and decorations by Liso Christmas, located at Heymansdries 71B, 1640 Sint-Genesius-Rode, with company number BE0779.978.780.
1.2 By placing an order with Liso Christmass, the renter agrees to these general terms and conditions.
1.3 Any deviations from these general terms and conditions are only binding if confirmed in writing by Liso Christmas.
2. Offer and Contract
2.1 All offers from Liso Christmas are without obligation and subject to availability.
2.2 A contract is formed once the customer places an order and it is confirmed by Liso Christmas in writing or electronically.
2.3 Liso Christmas reserves the right to refuse an order without providing a reason.
3. Rental Period
3.1 The rental period starts on the day the Christmas tree and/or decorations are delivered by Liso Christmas and ends on the agreed pick-up date.
3.2 The standard rental period is 6 weeks, unless otherwise agreed. The extension of the rental period is only possible upon agreement and with an additional fee.
4. Prices and Payment
4.1 All prices are exclusive of VAT, unless stated otherwise.
4.2 Payment must be made prior to or upon delivery, unless otherwise agreed in writing.
4.3 In case of late payment, Liso Christmas reserves the right to suspend the delivery until the payment is made.
5. Delivery and Pick-up
5.1 Liso Christmas ensures the delivery of the Christmas tree and associated decorations to the address provided by the renter.
5.2 Delivery takes place on the date and time agreed upon with the renter.
5.3 The pick-up of the Christmas tree and decorations is carried out by Liso Christmas on the agreed pick-up date.
5.4 If the renter is not present on the agreed pick-up date, Liso Christmas may charge additional fees for a new pick-up attempt.
6. Deposit and Damage
6.1 Liso Christmas may request a deposit, which will be refunded after inspection of the rented Christmas tree and decorations, provided they are in good condition.
6.2 The renter is responsible for any damage to the Christmas tree and decorations during the rental period, except for normal wear and tear.
6.3 In case of damage, loss, or theft of the Christmas tree or decorations, the costs will be charged to the renter based on the replacement value or repair costs.
7. Cancellation
7.1 The cancellation of the order can be made free of charge up to 10 days before the scheduled delivery date.
7.2 In case of cancellation within 2 days before the delivery date, the renter is liable for 50% of the rental amount.
7.3 In case of cancellation on the day of delivery or if the renter refuses to accept the Christmas tree, the full rental amount will be due.
8. Use and Responsibilities
8.1 The rented Christmas tree and decorations remain the property of Liso Christmas at all times.
8.2 The renter must use the Christmas tree and decorations in a responsible manner and protect them from damage, fire, and theft.
8.3 The renter may not make any modifications to the Christmas tree or decorations without written permission from Liso Christmass.
9. Liability
9.1 Liso Christmas is not liable for any direct or indirect damage resulting from the use of the rented Christmas tree and decorations, unless in cases of intentional misconduct or gross negligence.
9.2 The renter indemnifies Liso Christmas against all claims from third parties regarding damage caused by the use of the rented Christmas tree and decorations.
10. Force Majeure
10.1 Liso Christmas cannot be held liable for delays or failures in the performance of the contract due to force majeure. Force majeure refers to any circumstance beyond the control of Liso Christmass, such as extreme weather conditions, government measures, or transport issues.
11. Complaints
11.1 Complaints regarding the delivered Christmas tree or decorations must be reported in writing or via email to Liso Christmas within 24 hours of delivery.
11.2 Liso Christmas will handle complaints as soon as possible and, if justified, proceed with repairs or replacements.
